REGULATIONS OF BOBO COWORKING

Section 1 – DEFINITIONS

VIRTUAL ADDRESS – an address made available to Users for a fee upon prior consent of BOBO Holdings. A selected specific package shall be shown on the Membership Card.
PRIVATE OFFICE – an office made available exclusively to the User for a fee. BOBO Holdings shall provide glazed private offices which can accommodate 2 to 6 persons and with full furniture: desk, employee chair, container, hangers, blinders, touch light switches and individually controlled air conditioning / heating system. A selected specific office shall be shown on the Membership Card.
PRIVATE DESK (DEDICATED) – a desk made available exclusively to the User for a fee in areas marked in the Facility. For each desk, a cabinet with a code door lock is provided free of charge. BUILDING – the building situated at 70 Prosta street, 00-838 Warsaw, which hosts the Facility.
COMMUNITY MANAGER – an Account Manager, a persons responsible for direct contacts with a Coworking community to whom all requests and issues should be reported. He ensures positive relationships and work atmosphere to Users and manages conference room rental and events. He is the first line of contact between Users and BOBO Holdings.
HOT DESK – a desk made available to the User for a fee in areas marked in the Facility without an exclusive-use option. A selected Hot Desk type shall be shown on the Membership Card.
MEMBERSHIP CARD – a document which is attached to the Membership Agreement as Annex 4. It clarifies the terms & conditions and the subject- matter of the Membership Agreement with respect to a specific User.
FACILITY – part of the Building.
SPACE – part of the Facility being the subject-matter of the Membership Agreement with a User (i.e. a Private Office, a Private Desk or a Hot Desk).
SHARED SPACE – an area which is not dedicated to individual use and can be used by any Users, including Employees / Associates of the User in the Facility. This area covers: kitchens, reception desks, toilets, showers, relaxation and gaming zones, library, copy room / printing room, rooms for loud conversations.
EMPLOYEES / ASSOCIATES – any persons authorised by the User to use the Facility who is added to the List of Employees/Associates which is attached as an Annex to the Membership Agreement. The provisions of these Regulations which are related to Users shall also apply, as appropriate, to Employees / Associates, with the exclusion, in particular, of the provisions concerning a User’s liability for acts of Employees / Associates.
“EVENT ZONE” SPACE – space dedicated to events where meetings can be arranged for up to 70 persons. It is equipped with tables, projectors, a PA system, air conditioning and is made available to a User for an additional fee as part of additional services and limits covered by his package.
RECEPTION DESK – a place situated in the Facility in the Building which is dedicated to receiving visitors and correspondence.
REGULATIONS – this document.
QUIET ZONE – areas used by Users where silence should be maintained. They cover the area of (dedicated) Private Desks, the Hot Desk zone and the library.
CONFERENCE ROOMS – rooms where meetings with participation of 4 to 16 persons can be arranged, equipped with tables, projectors, a PA system, air conditioning: ‘CHAT’, ‘BIG IDEA’, ‘GOSSIP’, ‘MEET UP’, ‘GREAT SPACE’, which are made available to the User for an additional fee as part of additional services and limits in his package.
MEMERSHIP AGREEMENT / AGREEMENT – an agreement between BOBO Holdings and a User for use of Space and/or a Virtual Address.
USER / USERS – natural persons or legal persons or organisations without legal personality which have signed a Membership Agreement with BOBO Holdings or a different entity which uses Space and/or a Virtual Address on a different basis.
BUILDING ADMINISTRATOR / OWNER – Erlend Investments sp. z o.o.

Section 2 – GENERAL PROVISIONS

  1. These Regulations set out the rules of functioning of the Facility.
  2. These Regulations sets out the organisation and order in the process of use of the Facility of BOBO Holdings and lays down the rights and obligations of BOBO Holdings / a User connected therewith.
  3. These Regulations shall apply to all Users, visitors, Employees, Associates and other entities which want to use services offered by BOBO Holdings.
  4. User and his Employees and Associates will comply with these Regulations.
  5. User, including his visitors, Employees / Associates, third parties or any other persons using the Facility, will not initiate in the workplace, Shared Space, Conference Rooms or in their vicinity any activities which limit or violate, in any manner, the rights of other Users, visitors or other persons, tenants in the Building or visiting the Building, or any activities which can lead to an accident involving any of the above mentioned persons.
  6. User and his Employees and Associates will not cause, continue or allow any disorder inside, on or around the Facility or Building. They will not store any waste inside or around the Facility or Building and will not allow such storage. They will not infringe the right to undisturbed use of rooms vested in any other Users in the Facility and in the Building.
  7. User undertakes to immediately shut off any utilities which cause or inflict any damage in the Facility or in the Building and to notify BOBO Holdings or a person authorised by BOBO Holdings of such shut-off without delay.
  8. User undertakes to keep the Space clean and tidy and not to store any waste on it longer than necessary and not to keep waste in any places other than waste bins or other containers dedicated to such waste storage at places temporarily designated by BOBO Holdings.
  9. User, his visitors, Employees and Associates, clients and persons invited by the User or other entities connected with the User must comply with any regulations applicable in the Facility and the Building, including but not limited to these Regulations. The User shall be responsible for any losses and consequences arising from a violation of these Regulations caused by the User, his representatives, contractors, employees and associates, persons invited by the User or any other entities connected with the User as for his own acts. BOBO Holdings may amend or supplement regulations at any time. The provisions of such amended or supplemented regulations will come into force upon promulgation. The content of regulations may be viewed at the Reception Desk of BOBO Holdings.

Section 3 – FORMAL ISSUES

GENERAL:
  1. BOBO Holdings provides services which include making available for use a Virtual Address, Private Offices, Private Desks, Hot Desks and Conference Rooms / meeting and event rooms in the Facility.
  2. A User shall have access to electricity and heating, water, toilets and other benefits arising from his Membership Agreements.
  3. Access to Space shall be paid in advance before the use of such Space is started or, at the latest, on the day the use of such Space is commenced provided that a proof of such payment and a proof of payment of a refundable Security Deposit have been provided.
MAKING SPACE AVAILABLE:
  1. Space shall be made available under a signed Membership Agreement and upon presentation of a proof of payment of the Security Deposit and under a Space delivery report.
  2. User must notify BOBO Holdings of any failures, defects and other damage identified by the User or caused by acts of the User or his Employees, Associates or Visitors.
OTHER ISSUES:
  1. BOBO Holdings reserves the right to enter the Space of a User with or without prior notification for purposes connected with ensuring security, in emergency situations or for any other purpose.
  2. BOBO Holdings may temporarily move the equipment from such Space. BOBO Holdings reserves the right to make changes on Space or to move it, provided that this will not lead to any significant reduction in the Space used by the User or amenities connected with such Space.
  3. BOBO Holdings may also modify or reduce the list of services provided to the User or the equipment made available on such Space at any time, to which the User hereby consents. Services may be provided by BOBO Holdings, its affiliated company or a third party.

Section 4 – BENEFITS OF MEMBERSHIP

BOBO Holdings shall make every effort to make available to a User and to ensure that the User has access to the services specified below, depending on the selection made by the User on the Membership Card: FOR USERS WHICH USE A PRIVATE OFFICE, PRIVATE DESK AND HOT DESK:
  1. a prestigious and convenient location and a workspace which is both uniquely designed and inspiring;
  2. a right of access to and use of air-conditioned and heated Private Offices, Private Desk zones marked on the Membership Card and access to Shared Space in the Facility;
  3. a right to use all furniture and equipment in the designated Private Offices and Private Desk zone in accordance with the selection marked on the Membership Card;
  4. a right of unlimited use of drinks, i.e. coffee, tea and filtered water;
  5. a right to use regular breakfasts and to participate in other events arranged for Users (including Employees and Associates);
  6. a right to use, free of charge, Conference Rooms (after prior booking), a printer, scanner, shredder and copier in accordance with a limit specified on the Membership Card. In the event that a determined limit is exceeded, the prices from the Fees / Services Price List will apply and any unused limit is neither transferable to next months nor refundable in any manner;
  7. access to a LAN network (in Private Officer / at Private Desks) and unlimited access to WiFi (which is available in the entire Facility);
  8. regular maintenance of the Facility by BOBO Holdings;
  9. receipt of mail, letters and supplies during business hours of the Reception Desk of the BOBO Holdings office, i.e. Monday to Friday, between 9:00 a.m. and 5:00 p.m., except for statutory holidays;
  10. 24/7 access to the Space, unless the Membership Agreement provides otherwise;
  11. support by a Community Manager;
  12. free of charge parking lot for bicycles in the underground car part in the Building;
  13. access to internal communication tools:
  14. COBOT https://bobocoworking.cobot.me as a contact website for each User on which each User can view his invoices and book conference rooms;
    SLACK – an internal messenger for Users to communicate with other Users and with BOBO Holdings;
  15. standard services which include everyday cleaning and surveillance in the Facility;
  16. a right to participate in events available exclusively to Users, including their Employees and Associates, and to use benefits and promotions prepared for Users, including their Employees;
FOR USERS WHICH USE A VIRTUAL ADDRESS:
  1. an option to use a prestigious address as the registered seat of a User;
  2. receipt of mail, letters and supplies during business hours of the Reception Desk of the BOBO Holdings office, i.e. between 9:00 a.m. and 5:00 p.m., except for statutory holidays;
  3. Access to internal communication tools:
  4. COBOT https://bobocoworking.cobot.me as a contact website for each User on which each User can view his invoices and book conference rooms;
    SLACK – an internal messenger;
  5. a right to participate in events available exclusively to Users.

Section 5 – RULES OF OPERATIONS AND USE OF SPACE, SHARED SPACE, CONFERENCE

ROOMS AND EVENT ZONE:
GENERAL:
  1. A User, his Associates, Employees and visitors shall be entitled to be in and use the Space, Shared Space, Conference Rooms, Event Zone and Quiet Zones in accordance with the rules which are set out in these Regulations.
  2. A User, his Associates and Employees may not use the Space or its part for any purposes other than the purpose described in the Membership Agreement.
  3. Users shall be responsible for ensuring that their business activities are run in accordance with applicable laws and regulations.
  4. A User and his Employees / Associates must use the Space, Shared Space, Quiet Zones, Event Zone and Conference Rooms in accordance with their intended use, applicable laws and regulations and requirements of appropriate use, and in particular to comply with applicable laws and regulations related to fire safety, occupational health and safety and operation of buildings;
  5. A User and his Employees / Associates must use the power, gas, water, computer, telephone and other systems in the Building so that they will not be destroyed, contaminated, overloaded or damaged so that they are out of use;
  6. For each of the Employees and Associates of a User, separate access to workplace must be bought (one person – one desk principle). A situation where more than one Employee or Associate use one access is inadmissible.
  7. BOBO Holdings shall not be responsible if a User uses his Space for a time shorter than the term for which the Membership Agreement has been signed, and in particular the User will not be entitled to any reduction in fees if such a situation occurs.
  8. A User shall not be entitled to assign any rights and obligations arising from these Regulations or his agreement with BOBO Holdings to any third parties, and in particular the User is prohibited to either sublease the Space or make it available for use free of charge. Any violation of the above obligation will result in an extra charge for the use of the Space in an amount equal to the User’s monthly subscription fee, for each such violation. The User may authorise a third party in writing to use the Space in the User’s place. Such authorisation should be submitted to BOBO Holdings with the signatures of persons authorised to represent the User or with the signature of the User.
  9. A User must notify BOBO Holdings of any failures or defects in the Space, Shared Space, Event Zone and Conference Rooms.
ACCESS OF A USER TO SPACE AND SHARED SPACE:
  1. It is possible 24 hours 7 days a week, unless the Membership Agreement or the Membership Card provides otherwise. The above provision shall not apply to visitors, who are authorised to visit a User exclusively during business hours of the Reception Desk (Monday to Friday, 9:00 a.m. – 5:00 p.m.).
  2. Users acknowledge that the other Space in the Facility has been made available for use to third parties, including entities having a comparable or identical business profile, and, therefore, undertake to use their Space, Shared Space, Conference Rooms and Event Zone so that the above places can be jointly used by other Users and, moreover, will not make any claims in connection with such shared use.
  3. After the Membership Agreement is terminated or expires, BOBO Holdings will not receive any correspondence for a User and will not bear any responsibility for that.
INTERNET CONNECTION:
  1. Each User shall have unlimited wireless access to the Internet in the Facility with a guaranteed capacity of 100/100 Mbps.
  2. A separate VLAN network may be created for an additional fee.
  3. A User is prohibited to use that connection to download and/or make available any unlawful contents and if this obligation is violated, the services may be discontinued with immediate effect.
  4. BOBO Holdings shall not be held liable for any losses incurred as a result of the unavailability or incorrect operation of the Internet line if the incorrect operation of the line is due to any reasons attributable to its provider.
ORDER:
  1. Users must use their Space, Shared Space, Conference Rooms, Event Zone and the infrastructure installed in there in accordance with their intended use. Users are prohibited to make any repairs, regulations (except regulating temperature), taking into pieces or disassembly on their own and to use any additional electric heaters or lighting of any kind. Every new User will be trained by an employee of BOBO Holdings who will teach the User how to use properly the equipment and systems in the Facility.
  2. Users (and their Employees, Associates, clients and visitors) must use their Space, Shared Space, Conference Rooms and Event Zone so that other Users and tenants of the Building can do their work undisturbed.
  3. Users, Employees, Associates and visitors must duly secure the Space and any things in it, as well as Shared Space, from any damage, destruction or loss.
  4. Users, Employees and Associates shall not be entitled to carry out any work in the Building, except for office work connected with their activity.
  5. Users, Employees and Associates must keep clean and tidy their Space, Shared Space, Conference Rooms and Event Zone. This shall also include an obligation to put dishes in a dishwasher.
  6. Meals, loud telephone conversations, listening to music and any other activities which can generate noise shall only be allowed in dedicated space.
  7. In the event that carpets, walls, ceilings, upholstered furniture or any other parts of equipment or system on the Space have become permanently dirty or have been destroyed or damaged, the User must pay the cost of cleaning and repairs.
  8. Storing any objects which should be kept in a warehouse, any large-size objects or hazardous or flammable objects or substances etc. in the Building is prohibited. BOBO Holdings shall be entitled, at any time, to remove such objects or substances or to have them stored at the expense and risk of the User.
  9. Users, Employees and Associates shall not be entitled to make any keys, IDs or other forms of access to the real property available to any third parties, including visitors, and to make available or disclose any access passwords and codes.
  10. On the Shared Space and Space, smoking and using electronic cigarettes and using any substances, and in particular narcotics and designer drugs is absolutely prohibited.
  11. All Users and their visitors should use a dressing room or clothing stands (private rooms).
  12. BOBO Holdings allows drinking alcohol exclusively in specified situations which result from organisation of employee / other events and which must be notified to BOBO Holdings for acceptance not later than one day before a planned event. In any other cases, a justified suspicion that the User or his Employee or Associate is under the influence of alcohol or intoxicating / unlawful substances may lead to the expulsion of such person from the Building or Facility.
RULES OF USE OF A USER’S SIGNS AND ADVERTISING:
  1. A User shall not have a right to place, on his own, his signs, advertising and banners in the Building, except where they are located in designated places upon the prior consent of BOBO Holdings.
  2. An information board must not infringe the rights of any third parties and, moreover, the User will be exclusively responsible for it, and in particular for any infringement of a trademark or other intellectual property rights.
  3. Users shall not be entitled to place their advertising, signs or boards and to run any advertising and marketing activities in Shared Space.
  4. Users hereby undertake to refrain from using or copying for any purpose: (a) the names “BOBO”, “BOBO Coworking”, “BOBO Holdings” or any other business names, trademarks, service marks, logos, designs, copyrights, patents, company secrets, commercial marks, marketing materials, other signs or identifying information or any other intellectual property of BOBO Holdings (“BOBO Holdings Intellectual Property”); (b) developments, modifications and similar versions; (c) photographs or illustrations of any part of the Facility, for any purposes, including for competition purposes, without the prior written consent of BOBO Holdings; provided that during the term of the Membership Agreement Users may use the words “BOBO Coworking” as plain text for the purpose of proper identification of their address or location of their office.
  5. Users shall not be entitled to use any BOBO Holdings Intellectual Property in any advertising materials, which applies, in particular, to any domain names, account names in social media and any form of media which will be invented in the future, without the prior written consent of BOBO Holdings.
  6. Users shall not have a right to film the Facility, including the Space, without submitting the necessary documents and without the express prior written consent of BOBO Holdings.
  7. In the event of violation of the above provisions (1 to 6), a User must pay a contractual penalty of PLN 1,000 for each violation, which will not exclude BOBO Holdings’ right to seek damages in excess of that contractual penalty.
PRIVATE OFFICES:
  1. The use of and access to Private Offices shall be allowed after a Membership Agreement is signed and the fees connected with such agreement are paid.
  2. BOBO Holdings shall ensure a right to book a selected Private Office in accordance with the Membership Agreement.
  3. The User shall be bound by all the other provisions set out in these Regulations.
PRIVATE DESKS (DEDICATED):
  1. The use of and access to Private Desks shall be allowed after a Membership Agreement is signed and the fees connected with such agreement are paid.
  2. BOBO Holdings shall ensure a right to book a selected place / workplace in accordance with the Membership Agreement.
  3. Under the Membership Agreement the User shall have a right to use locked cabinets free of charge.
  4. BOBO Holdings reserves a right to modify and change the areas of Private Desk zones.
  5. The User shall be bound by all the other provisions set out in these Regulations.
HOT DESK:
  1. The use of and access to Hot Desks shall be allowed after a Membership Agreement is signed and the fees connected with such agreement are paid.
  2. BOBO Holdings shall ensure an available Hot Desk in the coworking zone without prior designation. The User shall not have a right to book the same Help Desk he was using previously.
  3. The User should not leave his personal belongings unattended at Hot Desks for a time longer than one hour. As a rule, the Hot Desk zone shall be available to every User which has bought a Hot Desk subscription and no places can be booked by leaving one’s own belonging there. All belongings left unattended for a time that is longer than the time limit set out above may be moved to BOBO Holdings’ storeroom. Storage of belongings may result in extra costs in connection with such storage. Simultaneously, BOBO Holdings accepts no responsibility for leaving such belongings unattended.
  4. BOBO Holdings reserves a right to modify and change the areas of Hot Desk zones.
  5. The User shall be bound by all the other provisions set out in these Regulations.
LOUD CONVERSATION ROOMS:
  1. BOBO Holdings may provide to Users available rooms or boxes as rooms for use during loud telephone conversations or to listen to music or to carry out other activities that can generate noise or disturb other Users in the Facility.
  2. Details are provided by the Reception Desk.
  3. BOBO Holdings reserves a right to modify and change the rooms for loud conversations.
QUIET ZONES:
  1. Every zone in the space of BOBO Holdings which is used for work, i.e.: Private Offices, Private Desk zones, Hot Desk zones and library, is a place where absolute silences must be maintained and the work of other Users must not be disturbed. Any violation of the comfort work rules or complaints of other Users about behaviour which breaks silence will be deemed to be a grave breach of these Regulations, with all the consequences. Please ensure mutual comfort and respect for your own work and the work of the others.
  2. BOBO Holdings reserves a right to modify and change the areas of Quiet Zones.
LIBRARY – BOOK LENDING:
  1. BOBO Holdings shall make available to Users books which are kept on shelves. Books may only be used in the Facility. Taking books outside the Facility is prohibited.
  2. Books can be borrowed after prior notification to an employee of BOBO Holdings. The title, author and planed time of use of a book should be notified. The employee will confirm that the book has been lent by e- mail to the mailbox of the User.
  3. The library shall be available to visitors, Employees and Associates of the User on the same terms and conditions which apply to the User.
  4. The User shall be fully responsible for any damaged or lost book or for failure to return it on time.
SHARED SPACE:
  1. The use of and access to Shared Space shall be allowed after a Membership Agreement is signed and the fees connected with such agreement are paid.
  2. Users shall have access to Shared Space during the time they have been granted under the Membership Agreement and subject to availability. A User shall not have any right to book Shared Space.
  3. Shared places: Kitchen, Library, Hot Desk zones, relaxation zones, gaming zone, toilets, printer / copy room, loud conversation rooms, Quiet Zones.
  4. BOBO Holdings reserves a right to modify and change the areas of Shared Space.
  5. The User shall be bound by all the other provisions set out in these Regulations.
CONFERENCE ROOMS AND EVENT SPACE:
  1. The use of and access to Conference Rooms and event space shall be allowed after a Membership Agreement is signed and the fees connected with such agreement are paid or after the fees for access to and use of Conference Rooms and event space are paid.
  2. The following conference rooms shall be generally available: ‘CHAT’, ‘BIG IDEA’, ‘GOSSIP’, ‘MEET UP’ and ‘GREAT SPACE’, and the ‘EVENT ZONE’ space.
  3. BOBO Holdings reserves a right to reduce the number of available Conference Rooms and event space. The current availability can be checked via COBOT or at the Reception Desk of BOBO Holdings.
  4. Access shall be allowed during business hours of the Reception Desk (Monday to Friday, 9:00 a.m. – 5:00 p.m.) or as agreed with BOBO Holdings.
  5. In the case of organisation of meetings, events or conferences where waste, such as bottles or boxes, is generated, BOBO Holdings shall have a right to charge extra cleaning costs payable by the User at a rate of PLN 60 per hour (exclusive of VAT).
  6. BOBO Holdings reserves a right to modify and change the areas of Conference Rooms and event space.
  7. The User shall be bound by all the other provisions set out in these Regulations.
VIRTUAL ADDRESS:
  1. The use of and access to a Virtual Address shall be allowed after a Membership Agreement is signed and the fees connected with such agreement are paid.
  2. The User shall be bound by all the other provisions set out in these Regulations.
VISITORS OF A USER:
  1. Each User shall have a right to invite visitors. Visitors may be received in Shared Space. Visitors may be brought in the Space after they were notified to and accepted by BOBO Holdings.
  2. Visitors should be notified to the Reception Desk. A notification should include the first and last name of a visitor. Visits shall be allowed during business hours of the Reception Desk (Monday to Friday, 9:00 a.m. – 5:00 p.m.) or as agreed with BOBO Holdings. The visit by a visitor must not be of permanent and continuous nature, which could be deemed by BOBO Holdings to be the use of space under the rules set out in the Membership Agreement.
  3. A meeting with visitors should be held in Private Offices, Conference Rooms or, exceptionally, in the reception zone (in this case a visit should not be longer than 10-15 minutes).
  4. BOBO Holdings recommends meetings in Conference Rooms, after prior booking, in order to ensure that the work of other Users is not disturbed.
  5. In the event that any reservations could be raised about the use of the Space by his visitors, a User must notify BOBO Holdings of such planned visits. BOBO Holdings shall examine and verify such situations on a case by case basis.
  6. A User shall be responsible for any damage inflicted by his visitor.
  7. In the event that a visitor is received in the Space without prior notification procedure or the meeting with a visitor is held in a place other than the meeting place designated by BOBO Holdings, the User will be obliged to pay a fee for use of coworking space in an amount of PLN 100 for each case when a visitor was brought in. Such fee shall be added to the monthly subscription fee payable by the User after informing the User of the amount of the fee.
  8. In the event that the visit by a visitor is deemed to be regular use, BOBO Holdings will have a right to ask the User to pay any additional costs for use of space in accordance with the rules of use applicable to the User.
  9. The User and the visitor shall be bound by all the other provisions set out in these Regulations.

Section 6 – RULES OF OPERATION OF THE RECEPTION DESK

  1. The Reception Desk shall be open Monday to Friday between 9:00 a.m. and 5:00 p.m. (with the exclusion of statutory and other holidays).
  2. During the business hours of the Reception Desk, Users shall have access to reception services in accordance with their respective Membership Agreements.

  3. STANDARD SERVICES SHALL INCLUDE:
    • accepting bookings and providing information on available Conference Rooms,
    • helping with office equipment,
    • helping with copying documents,
    • receiving correspondence delivered by fax, mail or courier, except for parcels above 5 kg and dimensions exceeding 50 cm x 50 cm x 50 cm,
    • receiving visitors coming to Users and showing them the way to meeting places, including the preparation of a Conference Room,

    EXTRA SERVICES
    (additional fees may apply):
    • scanning and sending correspondence to mailboxes of Users,
    • serving visitors of Users,
    • making available office equipment and accessories.
  4. A User shall grant BOBO Holdings an appropriate power of attorney / authorisation to receive correspondence. The power of attorney / authorisation referred to in the preceding sentence shall not authorise its holder to receive incoming mail from the Post Office upon an advice note. The Reception Desk shall not be responsible for any defects of electronic mail or for a User’s failure to receive the message about a letter.
  5. Users shall be entitled, in accordance with their respective subscriptions, to provide the address: ul. Prosta 70, 00-838 Warszawa as their correspondence address.
  6. Unless agreed otherwise, a User shall receive his correspondence from the Reception Desk in person. Any correspondence delivered by fax, mail and courier shall be kept for 1 month after delivery date. Thereafter, any correspondence not received by the User may be utilised.

Section 7 – BOOKING CONFERENCE ROOMS AND EVENT ZONE

AVAILABILITY:
Conference Rooms and the Event Zone shall be available both to Users and third parties (companies and persons which have not signed a regular Membership Agreement with BOBO Holdings).
COMMENCEMENT OF USE / BOOKING:
  1. A Conference Room or Event Zone may only be used after a Membership Agreement is signed and all the costs arising from that agreement are paid or, in case of entities which are not Users, after booking is made and the relevant fees are paid.
  2. Booking of a Conference Room and Event Zone by a User: it shall be made via the COBOT application, which is available to Users. Exceptionally, a Room may be booked at the Reception Desk of BOBO Holdings. Booking shall be confirmed by a message from BOBO Holdings.
  3. Booking of a Conference Room and Event Zone by third parties: it shall be made by mail or telephone or in person at BOBO Holdings after the fees for use are paid in advance in accordance with the Price List for Services and in accordance with the rules set out in these Regulations.
  4. Priority when booking: Users shall have priority when booking a Conference Room and Event Zone.
  5. The use of a Conference Room and Event Zone shall only be allowed during business hours of the Reception Desk (Monday to Friday, 9:00 a.m. – 5:00 p.m.) or as agreed with BOBO Holdings.
  6. A User must not give any hours he has as part of his subscription to other Users or any third parties.
  7. The hours of use of a Conference Room which a User has as part of his subscription shall not cumulate and shall not be transferred to subsequent settlement periods.
  8. Use of equipment in rooms: BOBO Holdings shall allow using equipment available in Conference Rooms (projector, screen, white board, flipchart). Coffee shall be offered in Conference Room for an additional fee. A User should order coffee or additional equipment from BOBO Holdings when making his booking.
  9. Exceeding a booked meeting time: BOBO Holdings shall allow using the Conference Room and Event Zone exclusively if there is no other booking. The fee shall be determined in accordance with the rules set out for the entity in question and pursuant to the Price List.
PAYMENTS:
  1. For bookings of Conference Rooms and the Event Zone, additional fees shall be charged in accordance with the Price List for Services and/or the rules set out on the Membership Card.
  2. If a User has made a booking, the fee for such booking of a Conference Room / Event Zone will be added to the general invoice for that User. As general invoices are issued in advance, 14 days prior to the next period of use, the above mentioned settlement of booking will be carried out in arrear from the day such booking was made, counted from the date of issuance of a general invoice, 14 days prior to next period of use of the space to the day the next general invoice is to be issued.
BOOKING CANCELLATION:
  1. A booking may be cancelled free of charge not later than 24 hours prior to the booked date and time. Thereafter, BOBO Holdings will charge a fee for the entire period covered by such booking. A booking date and time may be changed after contacting BOBO Holdings and checking if the Room is available on a different day and/or time.
  2. If a Room has been booked on the date of a meeting or the day directly preceding such date, such booking may only be cancelled after contacting BOBO Holdings. BOBO Holdings reserves a right to charge the booking costs to the booking party.
  3. BOBO Holdings shall process all such situations on a case by case basis.
  4. In the event that a booking has not been cancelled and the meeting is not held, BOBO Holdings will deem it a valid booking and charge the User for the entire period covered by such booking.

Section 8 – USE OF MULTI-PURPOSE EQUIPMENT

  1. Users shall be entitled to use multi-purpose machines (printer, scanners, copier, shredder) for the number of copiers or printouts specified for a given User in accordance with the limit on the Membership Card.
  2. Free of charge services shall include: scanning.
  3. A User may receive his incoming documents as scans in his private mailbox as part of the selected subscription (or for an additional fee).
  4. After the limits available under the Membership Agreement are exhausted, the cost of a service will be determined on the basis of the BOBO Price List for Services then in force.
  5. Multi-purpose equipment may be used 24 hours a day 7 days a week, unless access to the Space for a given User is determined differently.
  6. As part of use of his Space, a User may use his own equipment necessary for work to the extent such use does not violate these Regulations.
  7. In the event that a User has not utilised his subscription limits in a settlement period, such unused limits may not be transferred to the subsequent settlement period or deemed a basis for reducing the fee. The User shall not be entitled to assign his resources to another User or a third party.

Section 9 -OTHER ISSUES RELATED TO MAKING SPACE AVAILABLE


FAILURE TO ENSURE SERVICE / AVAILABILITY:
  1. In the event that BOBO Holdings, due to its fault, fails to provide a booked or purchased service or makes a Conference Room available to an unregistered person (failing to honour priority), the User shall be entitled to a 100% refund for such not- performed service, subject to points 2 and 3 below. Such a refund shall satisfy all the claims against BOBO Holdings with respect to booking or refusal to perform a service.
  2. BOBO Holdings reserves a right to limit the availability of the Facility (coworking zone), including the Event Zone, Conference Rooms and Shared Space, in the event of organisation of training courses, conferences and other events.
  3. Such limitations shall be published on SLACK (internal messenger) not later than 2 days prior to a planned date of limited availability. Such limitations shall give no right to deductions, discounts or damages. The current bookings of Conference Rooms may be checked via COBOT.
  4. BOBO Holdings shall not be held liable for inability to perform any services in the event of extraordinary circumstances or circumstances beyond BOBO Holdings’ control.
  5. A User shall be held liable for any acts and omissions of his visitors, Employees and Associates as for his own acts and omissions.
  6. A User shall be obliged to cover the costs of any damage caused by himself and his visitors, Employees and Associates, including the costs incurred to restore the Space to the condition from before the execution of the Membership Agreement.
  7. BOBO Holdings shall not be held responsible for performance of services by third parties.
QUESTIONS, PROBLEMS:
  1. Any questions, problems and comments related to the use of his Space may be sent by a User by e-mail to: pomoc@bobowork.com immediately after they are identified or emerge.
  2. Replies to any questions, problems and comments shall be provided within 14 calendar days after their receipt. Within that time limit, the User shall be notified of the decision related to his complaint by e-mail to the address indicated in the complaint.

Section 10 – FINAL PROVISIONS

  1. Users must comply with these Regulations.
  2. By accepting the provisions of the Membership Agreement and the terms and conditions of booking of Conference Rooms, a User also represents that he knows these Regulations.
  3. Any amendments to these Regulations shall become effective from their publication on the website or with the use of a communication tool between BOBO Holdings and Users, with no separate notification required.
  4. These Regulations may be viewed at the Reception Desk or on the website and will become effective on: 18 October 2019.
  5. The price list for BOBO services shall be available at the Reception Desk or on the website of BOBO Holdings.
